A Manhattan federal court has postponed Storm’s retrial until April 26, 2027, delaying proceedings on two charges that a jury failed to resolve during his first trial in 2025. The latest court order came on August 25, while U.S.

District Judge Katherine Polk Failla continues considering Storm’s pending motion for a judgment of acquittal. The retrial had previously been scheduled for October 26, 2026. The delay gives Storm additional time before prosecutors can again pursue charges of conspiracy to commit money laundering and conspiracy to violate U.S. sanctions.

Roman Storm Retrial Delayed to April 2027

Storm’s first trial concluded in August 2025 after four weeks of proceedings in the Southern District of New York. The jury convicted him on one count of conspiracy to operate an unlicensed money-transmitting business.

Federal prosecutors subsequently chose to retry Storm on the unresolved counts and initially sought a new trial beginning in October 2026. On April 24, Judge Failla scheduled the retrial for October 26, contingent on her ruling on Storm’s pending Rule 29 motion for judgment of acquittal.

Storm’s lawyers later asked the court to move the trial to April 26, 2027, or approximately 90 days after any decision allowing the retrial to proceed. On August 25, the court granted the request and officially adjourned the retrial until April 26, 2027.

Storm responded publicly, stressing that his acquittal motion remains undecided. The prosecution originally alleged that Tornado Cash helped process more than $1 billion in criminal proceeds, including funds connected to North Korea’s Lazarus Group.

The Justice Department has argued that Storm and other Tornado Cash founders knowingly developed, operated and promoted infrastructure that criminals could use to hide cryptocurrency transactions. The case dates back to a much broader regulatory fight around Tornado Cash.

In August 2022, the U.S. Treasury sanctioned the protocol over its alleged role in illicit cryptocurrency activity. EtherWorld covered the original decision in Crypto-Mixing Service Tornado Cash Banned by US Government.

Chainalysis Testimony Raises New Questions

Storm claimed that trial records showed Chainalysis had operated a Tornado Cash relayer during part of the period examined by prosecutors. A relayer helps users complete Tornado Cash withdrawals without requiring the receiving address to already hold ETH for transaction fees.

According to the court transcript excerpts highlighted by Storm, Chainalysis lawyers acknowledged that a relayer operated by the company had processed Tornado Cash transactions between approximately March and August 2022. Storm argued that this creates a contradiction at the center of his prosecution.

Storm also pointed to disputes involving attempts by his lawyers to subpoena Chainalysis employees. These claims reflect Storm’s interpretation of the public court record and do not establish misconduct by Chainalysis.

Tornado Cash Case Becomes a Test for Open-Source Developers

Storm argues that prosecutors are attempting to punish a developer for creating privacy technology that he did not ultimately control. Prosecutors have argued that the case involves substantially more than merely publishing code.

They allege that Storm and his co-founders operated parts of the Tornado Cash ecosystem, profited from it and continued supporting the service despite knowing it was being used for illicit activity. That disagreement is why the case has attracted significant attention from Ethereum developers and crypto advocacy organizations.

Ethereum co-founder Vitalik Buterin has repeatedly supported Storm’s legal defense. In 2024, Buterin donated another 100 ETH to the defense fund, bringing his contributions at the time to three separate donations. EtherWorld covered the contribution in Ethereum Bulletin #95.

Buterin has argued that Ethereum should preserve censorship resistance, open source, privacy and security, principles EtherWorld explored in Vitalik Urges Bold Thinking at Ethereum’s Application Layer. Those same themes are increasingly appearing at the protocol level.

What Happens Next for Roman Storm?

Judge Failla still needs to rule on Storm’s motion for judgment of acquittal. If that motion succeeds on some or all of the relevant issues, it could significantly alter the path toward another trial.

If it fails, prosecutors can proceed with the April 26 retrial on the unresolved money laundering and sanctions charges. Storm has meanwhile intensified his public campaign around the case.

In one of his latest posts, he said that he was afraid of speaking publicly about the prosecution but asked supporters to contact the White House, members of Congress and state officials.

Ethereum itself is pushing deeper toward privacy, self-sovereignty and censorship resistance.
